  • * From the scenario, analyze the primary problems associated with information management, and analyze the primary issues associated with patient confidentiality. Determine the major ways in which these overlapping responsibilities play a part in enforcing Health Insurance Portability and Accountability Act (HIPAA) mandates.

It is imperative that health care organizations adopt information management systems that are capable of collecting and sharing all health information on patients and their health care. Failure to maintain accurate and complete medical records may affect the ability or an organization or physician third-party reimbursement. Under federal and state laws, the medical records reflect accurately the treatment. Thus, the medical records are important to the organization for medical, legal, and financial reasons. Intentional alteration, falsification, or destruction of medicals record is grounds for liability in a medical negligence suit. Such negligence is ground for actual malice and causes compensable harm. The integrity of patient records is important in maintaining the caregiver’s credibility. Altered medical or business records can create a presumption of negligence (Pozgar 2016).

All health care professionals who have access to the medical records have a legal, ethical, and moral obligation to protect the confidentiality of the information in the record. It is the duty of the health care organization’s staff to maintain confidentiality of oral and written communication regarding their patients. All patient information, regardless of how it is acquired is confidential. The patient may give the physician consent to disclose certain information or it may be required by the law for legal reasons. HIPAA requires that various patient documents containing protected health information be stored in either written or electronic format for a certain period of time.

One of the problems with allied professional responsibilities and overlapping general roles as they apply to a multidisciplinary approach to patient care is understaffed and undertrained nurses. Allied Health has engaged in a number of studies that address the future of employees in health care delivery. They have also noted a great need for improved information management to support quality health care and evaluation. In order to better prepare health care professionals for a rapidly changing health care environment it is suggested that a curriculum for health care professionals should not only contain medical training but information technology as well.

According to the textbook and scenario, information management is critical to avoid issues associated with patient confidentiality. In the medical field, medical records are the source of truth. Therefore, they must be accurate in order to avoid potential lawsuits and to protect patients. The main issues are keeping the accurate description of any treatment given by physicians, nurses, or any other clinical agent. There must be agreeance and accurate descriptions of all patient’s health details. Changing any medical record can also result in lawsuits and can lead to misdiagnose or treat patients. Whenever a clinician makes a mistake on a record, the record can not be deleted or changes, it must be noted as a mistake, so all other clinical personnel knows and is aware. Transparency is essential. Patients have the right to access their medical records. When other physicians or facilities need a patient record for their care, there must be a release signed by the patient authorizing this other entity the access to the patient’s records. The safest way of giving a medical record to others is if the appropriate medical release authorization exists. All practices must comply with HIPAA regulations to protect their patient’s privacy and care. “Every American doctor cannot help but be familiar with HIPAA, or the “Health Insurance Portability and Accountability Act,” which created a national standard for accessing and handling health information.”(Wilkes, 2014).

As we all know, patient care involves many professionals. Allied professionals are all the people involved in the care of patients. For instance, therapists, physicians assistants, nurses, pharmacists, nurses, paramedics, and other caregivers. All professionals must work together logging and revising all patient’s information with detail. There have been many cases where physicians order a medication, but nurse or pharmacist end up releasing and administering another medicine. This kind of miscommunication or failure to record appropriate dosage or name of the medication can cause the death of a patient. Therefore, all caregivers must record and manage patient information appropriately and very carefully. Communication between all caregivers is key to the success of patients, and successful treatments. In the 21st century, hospitals and clinical personnel have the tool for electronic medical records. “For example, computer networks allow information systems to be interconnected, making digitally captured information stored in these systems easier to access. “(Li, 2014). EMR systems can avoid any miscommunication and avoid medical record tampering. This tool makes medical records a real source of truth. Thus, all medical professionals must be cautious with medical records and be proactive in recording all treatments and visits.
